Terms of Service Draft

1. Agreement

By accessing or using BranchWise (the "Service"), you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Service Description

BranchWise provides AI-assisted, question-led decision support and visual decision-tree tooling. The Service is intended to support structured thinking and documentation.

3. Not Professional Advice

BranchWise is an informational and workflow product. It does not provide legal, medical, financial, investment, tax, or other licensed professional advice. Users are responsible for independent judgment and appropriate professional consultation.

4. Accounts and Security

Users must maintain accurate account information and are responsible for safeguarding credentials and account access.

For OAuth users: third-party authentication (e.g., Google) verifies identity at login. OAuth provider access revocation may terminate active sessions and require re-authentication.

5. Acceptable Use

You agree not to:

• Access or attempt to access other users' data.
• Reverse engineer, probe, or exploit security vulnerabilities.
• Use the Service for unlawful, fraudulent, or rights-infringing activity.
• Upload malicious code or interfere with Service operation.

6. Customer Content and Ownership

You retain ownership of your input and generated decision artifacts ("Customer Content"), subject to the rights needed for us to operate the Service. You grant BranchWise a limited license to host, process, transmit, and display Customer Content solely to provide, secure, and improve Service operations.

7. Confidentiality and Data Use

BranchWise treats Customer Content as confidential business information and applies account isolation controls. BranchWise does not use Customer Content to train foundation models.

8. Free Tier and Limits

If a free tier is offered, it may include usage caps, feature restrictions, or storage limits. Limits may change with notice.

9. Availability and Changes

We may modify, suspend, or discontinue features at any time. We aim for reliability but do not guarantee uninterrupted or error-free operation.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. BRANCHWISE DISCLAIMS IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

To the maximum extent permitted by law, BranchWise and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, goodwill, or data.

12. Termination

We may suspend or terminate access for violations of these Terms or security risks. Users may stop using the Service at any time.
